AAD Calls for Modifications to Proposed EU ELV Regulation

Driving Sustainability and Competitiveness in Europe’s Automotive Sector

The proposed European Union’s End-of-Life Vehicles (ELV) Regulation has generated enthusiasm at the Andalusian Association of Dismantlers (AAD), an organisation within the automotive sector, who view it as a significant step towards enhancing competitiveness and standardising ELV treatment practices across Europe. However, the organisation expresses concerns about certain aspects of the draft and suggests modifications for the benefit of the industry.

Spain’s existing legislation, RD 265/21, provides a strong foundation for integrating with the new framework. While Spain’s current market conditions might not necessitate producer compensation to Authorised Treatment Facilities (ATFs), the organisation acknowledges that this may not hold true elsewhere, emphasising the need for economically viable ATF operations.

Spain´s existing legislation, RD 265/21, provides a strong foundation for integrating with the new framework. Its streamlined ELV deregistration processes with BATEVE (Telematic Vehicle Deregistration System) through the platform of the DGT (General Directorate of Traffic) guarantee deregistration solely and exclusively by the ATF, promote responsible vehicle handling and environmental stewardship. While Spain’s current market conditions might not necessitate producer compensation to Authorised Treatment Facilities (ATFs), the organisation acknowledges that this may not hold true elsewhere, emphasising the need for economically viable ATF operations.

AAD strongly advocates for market freedom, allowing consumers to choose their preferred ATF, thereby preventing market distortion and fostering healthy competition. They emphasise the importance of extending Producer Responsibility (EPR) networks to all legalised ATFs, ensuring comprehensive oversight and management of ELVs.

Flexibility is deemed crucial when it comes to dismantling ELVs. AAD suggests that mandates for part removal should consider advancements in post-shredding technologies and encourage collaboration between ATFs and shredding facilities. Additionally, limiting parts extraction and marketing to ATFs is seen as vital for environmental compliance, road safety, and consumer protection, aligning with the regulation’s overall objectives.

Addressing concerns raised by insurance companies regarding total loss vehicles is also imperative. Tighter control over their management is necessary to curb illegal activities and maintain traceability within the market.

As the electric vehicle (EV) landscape evolves, collaboration with regulatory bodies becomes increasingly critical. AAD highlights challenges like battery waste management and workforce training that need proactive solutions to ensure a smooth transition.

Access to comprehensive data on ELV treatment is crucial for informed decision-making. This data would empower policymakers and industry stakeholders to plan strategically, especially with the rising average vehicle age and the emergence of new technologies.

November 2023 meeting held in Brussels, EGARA Group analyzed the text of the new proposal for a European ELV regulation, proposing improvements together with Vitaute Bacianskaite and Jaco Huisman from the Directorate General for the Environment of the European Commission.

While AAD supports the ELV Regulation’s general objectives, they believe that refining certain aspects, such as market freedom, flexibility in dismantling, and data access, would optimise its impact on Europe’s automotive sector. By fostering collaboration, transparency, and adaptability, the industry can pave the way for a sustainable and competitive future.
