Proposed Laws On Administrative Seizure: ADA Hearing And Proposed Amendment

On 2nd July 2024, President of the National Association of Vehicle Demolishers (ADA), Anselmo Calò, was heard by the Transport Commission regarding the proposed laws for the cancellation from the public registers of end-of-life vehicles subject to administrative seizure presented to the Commission following the contacts of the same President Ada with the Deputies Andrea Casu, Gaetana Russo and Andrea Caroppo.

During the hearing, President Calò stressed that these proposals aim to solve a practical problem that has persisted for years. The problem concerns vehicles registered in public registers that, once subjected to administrative seizure, cannot be used by owners who are in debt to public bodies.

This entails a significant cost for the community since often the seized vehicles are stored in depots or abandoned in private premises, becoming waste or “out of use” vehicles. However, under current law, such vehicles cannot be disposed of while they are subject to administrative seizure since the seizure protects public credit.

The new bills are, therefore, aimed at breaking this vicious circle, allowing the disposal of end-of-life vehicles even if subject to administrative seizure. The recording of the hearing is available HERE.

Following the hearing, the Association, together with Assoambiente and ADQ, highlighted, in particular with regard to the proposal whose first signatory is the Hon. Gaetana Russo, the need to exempt from the declaration of unusability of end-of-life vehicles (for scrapping purposes), vehicles more than eight years old from first registration and vehicles subject to administrative seizure for more than five years.

In fact, the provision of a declaration of unusability by the owner himself for vehicles that are not visibly unusable (e.g. burned or damaged) due to the cumbersome procedure for issuing the certificate, especially in large municipalities, creates, on the one hand, a problem of identifying the competent authority to issue such a declaration and on the other encourages the abandonment of vehicles, as often the citizen, who finds himself in possession of a vehicle subject to seizure, prefers to abandon it rather than start a bureaucratic process that is not guaranteed to bring any results.
